[ARCHIVED] Notice to Bidders: 2021 Jefferson Avenue Drainage Improvement Project

NOTICE TO BIDDERS

2021-03STI Jefferson Avenue Drainage Improvements

 

Sealed original bids will be received by the City Council of Brookings, South Dakota, at the office of the City Clerk at the Brookings City & County Government Center, 520 3rd Street, Suite 230, Brookings, South Dakota, until 1:30 P.M. CST, Tuesday, February 16, 2021, for 2021-03STI Jefferson Avenue Drainage Improvements.  All bids will then be publicly opened and read.   

 

Such bids are to provide for the following approximate "WORK QUANTITIES": Approximately 2000 LF of RCP Storm Sewer ranging from 18” to 42” in diameter, Approximately 27 Storm Sewer Inlets and Junction Boxes,  Approximately 2,600 LF of Concrete Curb & Gutter, Approximately 3,000 SF of Concrete Sidewalk, Approximately 3,300 SF of Concrete Driveway Pavement, Approximately 2,600 Ton of Base Course, Approximately 1,000 Ton of Asphalt Concrete Surfacing, Approximately 1,300 LF of PVC Water Main ranging from 6” to 8” in diameter, Approximately 635 LF of PEX Water Service line, and all associated appurtenances, landscaping, and miscellaneous items.

 

Specifications and bidding blanks may be inspected and procured at the City Engineering Department, Brookings City & County Government Center, 520 3rd Street, Suite 230, Brookings, South Dakota, or online at www.cityofbrookings-sd.gov.  Bidders may contact the City Engineering Department at 605-692-6629 with questions or to be placed on the Planholders List.  Bidders shall contact Justin Bucher or Waylon Blasius of Banner Associates, Inc. at 605-692-6342 with questions regarding the general project, street construction and storm sewer construction.  Bidders shall contact Chad Bachman of Brookings Municipal Utilities at 605-692-6325 with questions regarding the water main and sanitary sewer construction. Bidders shall check for Addendums on the website.  Upon request, in accordance with South Dakota Codified Law 5-18B-1, one copy of electronic or paper Bidding Documents shall be furnished, without charge, to each prime contractor resident in South Dakota who intends, in good faith, to submit a bid to the Owner.  Additionally, if a paper copy is provided under the conditions of SDCL 5-18B-1, in consideration of the documents being provided at no charge, unsuccessful bidders agree to return the documents to the City of Brookings, at the address listed above, within thirty (30) days after the bid opening.

 

Each proposal must be accompanied by a certified check, cashier's check, or draft for five percent (5%) of the amount of the bid, such check to be certified or issued by either a State or National Bank, and payable to the City of Brookings, South Dakota, or in lieu thereof, a bid bond for ten percent (10%) of the amount of the bid, such bond to be issued by a surety au­thor­ized to do business in this State and payable to the City of Brookings.  The check or bond will be retained by the City as liquidated damages if the successful bidder refuses or fails to enter into a contract and performance bond in accordance with the bid when notified. All bidders are required to hold all applicable South Dakota tax licenses.  Bidder is required to furnish a Performance and Payment Bond in an amount not less than the contract price, for the faithful performance of the contract. Contractor shall promptly pay all persons supplying him/her with labor or material in the performance of the work provided for in the contract.  By virtue of Statutory Authority, preference will be given to materials, products, and supplies found or procured within the State of South Dakota.

 

Bidders on this work will be required to comply with the President’s Executive Order Nos. 11246 (Equal Employment) as amended, 11518 (Small Business Concerns), and 11625 (MBE) as amended. The requirements for bidders and contractors under these orders are explained in the specifications.

 

Any contract or contracts awarded under this Advertisement are expected to be funded in part by a loan from the South Dakota State Revolving Loan Fund. Neither the State of South Dakota nor any of its departments, agencies, or employees is or will be a party to this Advertisement or any resulting contract. This procurement will be subject to regulations contained in 40 CFR 35.936, 35.938, and 35.939.

 

Bidders on this work will be required to comply with Title 40 CFR 33 and executive order 12138. The goals and other requirements for Bidders and Contractors under this regulation which concerns utilization of Minority Business Enterprises (MBE) and Women’s Business Enterprises (WBE) are explained in the Specifications. The MBE goal for this project is 1% of the total dollar value of the job while the WBE goal is 4% of the total dollar value of the job.

 

NONDISCRIMINATION IN EMPLOYMENT

 

  1. Bidders on this work will be required to comply with the President’s executive orders Nos. 11246 as amended, 11458, 11518, and 11625 as amended. The requirements for bidders and Contractors under these orders are explained in the Specifications.

 

  1. The goal for female utilization which shall be included in all federal and federally assisted construction contracts and subcontracts in excess of $10,000 shall be 6.9%. The goal for minority utilization which shall be included in all federal and federally assisted construction contracts and subcontracts in excess of $10,000 shall be 0.8%. The goals are applicable to the Contractor’s aggregate on-site construction workforce whether or not part of that workforce is performing work on a federal and federally assisted contract or subcontract.

 

Work on this Project is subject to Davis-Bacon Provisions as indicated in the State Revolving Fund General Conditions.

 

The low responsive bidder will be required to certify to compliance with the American Iron and Steel provisions of the Consolidated Appropriations of Act of 2014. This certification form may be found on page AIS-21 of the State Revolving Fund (SRF) General Conditions and must be included in the bid proposal. Please be advised that waivers or exemption from the American Iron and Steel provision that cite International Trade Agreements DO NOT comply with the Consolidated Appropriations Act of 2014 as it applies to the SRF programs. Claims from suppliers that the American Iron and Streel provision does not apply to certain products based on the International Trade Agreement exemptions of the Consolidated Appropriations Act of 2014 will not be accepted.

 

The low responsive bidder must assure compliance with the requirements of Public Law 115-232, Section 889, Prohibition on Certain Telecommunications and Video Surveillance Services or Equipment.  Contractors must assure that telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities), and video surveillance and telecommunication equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities) WILL NOT be supplied for the project.

 

All bids must be signed and submitted in a sealed envelope and shall state on the left hand corner of the envelope “Bid for 2021-03STI Jefferson Avenue Drainage Improvements Any bids received after the deadline will not be accepted.

 

Bids may not be withdrawn within thirty (30) days after the actual opening thereof.  Action on the bids will occur within 30 days of the bid opening.  The City of Brookings reserves the right to waive irregularities and to reject any and all bids.
