Brookings City Council

June 27, 2023

 

The Brookings City Council held a meeting on Tuesday, June 27, 2023 at 6:00 PM, at the Brookings City & County Government Center, Chambers, with the following City Council members present:  Mayor Oepke Niemeyer, Deputy Mayor Nick Wendell, Council Members Wayne Avery, Bonny Specker, Brianna Doran, and Andrew Rasmussen.   Absent:  Council Member Holly Tilton Byrne, and City Attorney Steve Britzman.   City Manager Paul Briseno, and City Clerk Bonnie Foster were also present.

 

Agenda.  A motion was made by Council Member Wendell, seconded by Council Member Doran, that the agenda be approved.  The motion carried by the following vote:  Yes: 6 - Niemeyer, Wendell, Avery, Specker, Doran, and Rasmussen; Absent: 1 - Tilton Byrne.

 

Open Forum.  Jeanette Gibbons, Brookings, SD, encouraged the City Council to see the movie "The Sound of Freedom" at Brookings Theatre.   Cory Bingham, Brookings, SD, asked the City Council to discuss the reasons behind the City's new policy prohibiting the use of inflatables and dunk tanks in the City.

 

Consent Agenda.  A motion was made by Council Member Wendell, seconded by Council Member Doran, to approve the Consent Agenda.  The motion carried by the following vote:  Yes: 6 - Niemeyer, Wendell, Avery, Specker, Doran, and Rasmussen; Absent: 1 - Tilton Byrne.

A. Action to approve the June 13, 2023 City Council Minutes.

B. Action to abate property taxes in the amount of $29.13 for Parcel #40999-00006-157-00 Teresa Ritzer, c/o Teresa Hollomon, owner.  Legal description: Lamplighter Village #157 (mobile home on leased site).

C. Action on Resolution 23-056, a Resolution declaring surplus property for the City of Brookings.

Resolution 23-056 - Declaring Surplus Property

 

Whereas, the City of Brookings is the owner of the following described equipment

formerly used at the City of Brookings:

 

Dakotah Bank Center: 2 - Advance Aquaclean Extractor (does not work), Advance Walk

Behind Vacuum, Misc. Audio Equipment, Commodore Carpet Extractor (does not work),

2 - Generac Pressure Washer (does not work), Tennant Floor Scrubber, Tennant

Squegee Cart (missing parts)

 

Police Dept.: Misc. bikes: Black Mongoose, #3079; Black Adult Bike, Serial

#SNHTC17J47656, #3008; White and Green Huffy, #3030; Orange and Black Mongoose Stat 4, Serial #SNXP514B02450, #3009; and Green Trek 3700, Serial #1039U0210, #3017.

 

Whereas, in the best financial interest, it is the desire of the City of Brookings to dispose

of as surplus property; and

 

Whereas, the City Manager is hereby authorized to sell or dispose of said surplus

property.

 

Now, Therefore, Be It Resolved by the governing body of the City of Brookings, SD, that

this property be declared surplus property according to SDCL Chapter 6-13.

D. Action on City Council Ex-Officio Appointments: Brookings City & County Joint Board of Adjustment: Mayor Oepke Niemeyer, or their designee (designee:  Council Member Wayne Avery); Alternate: Deputy Mayor Nick Wendell (terms expiring June 1, 2024).

 

Proclamation.  Mayor Niemeyer presented a Proclamation to staff of the Parks, Recreation & Forestry Department recognizing July as Parks and Recreation Month.

MAYORAL PROCLAMATION

 

Whereas, parks and recreation promotes health and wellness; and

 

Whereas, parks and recreation promotes time spent in nature, which positively

impacts mental health by increasing cognitive performance, and alleviating illnesses

such as depression, attention deficit disorders, and Alzheimers; and

 

Whereas, parks and recreation encourages physical activities by providing space for

activities designed to promote active lifestyles; and

 

Whereas, parks and recreation increases economic prosperity through increased

property values, increased tourism, the attraction and retention of businesses, and crime reduction; and

 

Whereas, parks and natural recreation areas ensure the ecological beauty of our 

community and provide a place for children and adults to connect with nature and

recreate outdoors; and

 

Whereas, Brookings recognizes the benefits derived from parks and recreation

resources.

 

Now, Therefore, Be It Resolved, that I, Oepke G. Niemeyer, Mayor of the City

of Brookings, do hereby proclaim July as Parks and Recreation Month.

 

Ordinance 23-019.  A motion was made by Council Member Wendell, seconded by Council Member Doran, that Ordinance 23-019, an Ordinance Authorizing Amendment No. 5 to the 2023 Budget be approved.  The motion carried by the following vote: Yes: 6 - Niemeyer, Wendell, Avery, Specker, Doran, and Rasmussen; Absent: 1 - Tilton Byrne.

 

Resolution 23-058.  A public hearing was held on Resolution 23-058, a Resolution to Amend the 2040 Comprehensive Plan’s Future Land Use Map. A motion was made by Council Member Wendell, seconded by Council Member Rasmussen to approve the amended 2040 Comprehensive Plan's Future Land Use Map. The motion carried by the following vote:  Yes: 6 - Niemeyer, Wendell, Avery, Specker, Doran, and Rasmussen; Absent: 1 - Tilton Byrne.

 

Resolution 23-058 - A Resolution to Amend the Brookings, South Dakota Comprehensive Plan 2040

 

Whereas, the Comprehensive Plan provides a Major Street Plan Map, identifies a Future Land Use Map, projects population figures for the planning period, and describes an integrated land use vision for the City; and

 

Whereas, the owner of property legally described as the South Half (S ½) of the

Northwest Quarter (NW ¼) Excluding Platted areas and the North Half (N ½) of the Southwest Quarter (SW ¼) All in Section Thirty-Four (34) Township One-Hundred Ten

(110), Range Fifty (50) wishes to amend the Future Land Use Map for the area described from Open Space to Medium Density Residential; and

 

Whereas, the owner of property legally described as Outlots 2, 3 and 4 in Government

Lot 4 Excluding Lots H-1 and H-2 in the Northwest Quarter (NW ¼) of Section Six (6),

Township One-Hundred Nine (109), Range Forty-Nine (49) wish to amend the Future Land Use Map for the area described from Open Space and Mobile Homes to Urban Medium; and

 

Whereas, the City Council of the City of Brookings, SD held a public hearing in

accordance with SDCL 11-6-18 on the proposed amendment to the Future Land Use Map of the Brookings, South Dakota Comprehensive Plan 2040; and

 

Whereas, the City Planning Commission of the City of Brookings, SD has recommended approval of the amendments to the Future Land Use Map of the Brookings, South Dakota Comprehensive Plan 2040 in accordance with SDCL 11-6-17.

 

Now, Therefore, Be It Resolved that said amendment to the Future Land Use Map of the Brookings South Dakota Comprehensive Plan 2040 is hereby adopted by the City of

Brookings.

 

Temporary Alcohol Application.  A public hearing was held on a Temporary Alcohol Application from Sodexo Catering, to operate within the City of Brookings, South Dakota for a 50-year Reunion Dinner to be held on September 29, 2023 at the SDSU Alumni Center, 815 Medary Avenue. A motion was made by Council Member Doran, seconded by Council Member Specker, that the Temporary Alcohol Application be approved. The motion carried by the following vote:  Yes: 6 - Niemeyer, Wendell, Avery, Specker, Doran, and Rasmussen; Absent: 1 - Tilton Byrne.

 

Temporary Alcohol Application.  A public hearing was held on a Temporary Alcohol Application from Sodexo Catering, to operate within the City of Brookings, South Dakota for a Distinguished Alumni Awards Banquet to be held on October 14, 2023 at the SDSU Alumni Center, 815 Medary Avenue. A motion was made by Council Member Specker, seconded by Council Member Doran, that the Temporary Alcohol Application be approved. The motion carried by the following vote:  Yes: 6 - Niemeyer, Wendell, Avery, Specker, Doran, and Rasmussen; Absent: 1 - Tilton Byrne

 

FIRST READING – Ordinance 23-020.  Introduction and first reading was held on Ordinance 23-020, an Ordinance Establishing the Number of Video Lottery Machine Placements in the City of Brookings, SD.  Second Reading and Action: July 11, 2023.

 

FIRST READING – Ordinance 23-022.  Introduction and first reading was held on Ordinance 23-022, an Ordinance to Change the Zoning within the City of Brookings (Lot 2 in Block 9 of Freeland Addition).  Public Hearing and Action: July 11, 2023.

 

FIRST READING – Ordinance 23-023.  Introduction and first reading was held on Ordinance 23-023, an Ordinance to Change the Zoning within the City of Brookings (Outlots 2, 3 and 4 in Government Lot 4 in the NW ¼ of Section 6, Township 109, Range 49).  Public Hearing and Action: July 11, 2023.

 

FIRST READING – Ordinance 23-024.  Introduction and first reading was held on Ordinance 23-024, an Ordinance to Change the Zoning within the City of Brookings (Lots 1 -11 in Block 28 in Timberline Addition). Public Hearing and Action: July 11, 2023.

 

Progress Report.  Jake Meshke, Deputy City Manager, provided a progress report highlighting the City’s activities / projects.

 

City Council Member introduction of topics for future discussion.   Council Member Rasmussen asked for a report be shared with the City Council surrounding the new City policy prohibiting the use of inflatables and dunk tanks on City property. He would like to know the reason for the change, options explored, and rationale for the final decision.

 

Adjourn.  A motion was made by Council Member Wendell, seconded by Council

Member Doran, that this meeting be adjourned at 6:47 p.m.  The motion carried by a unanimous vote.
