An Ordinance Amending and Restating the
Swiftel Center Advisory Committee Ordinance
Be It Ordained and Adopted by the Council of the City of Brookings, State of South Dakota, as follows:
I.
Dacotah Bank Center Advisory Committee
Sec. 2-180. Established.
There is hereby established in and for the city, a Dacotah Bank Center Advisory Committee to act in an advisory capacity to the city council concerning the Dacotah Bank Center.
Sec. 2-181. Composition, appointment and initial terms.
The Dacotah Bank Center Advisory Committee shall be composed of seven (7) members selected as follows: five (5) persons shall be appointed by the Mayor with the advice and consent of the city council, with one (1) additional person from South Dakota State University and one (1) additional person recommended by the Visit Brookings Board also appointed by the Mayor, subject to the advice and consent of the City Council.
Sec. 2-182. Compensation; terms, vacancies.
- The members of the Dacotah Bank Center Advisory Committee shall serve without compensation.
- All terms after the initial appointment shall be staggered three (3) year terms. The initial terms shall be established based on the current terms of the Brookings Event Center, Inc. Each person who is a member of the initial Dacotah Bank Center Advisory Committee may be re-appointed for an additional three (3) year term.
- If a member resigns or is disqualified prior to the end of their term, the mayor, with the advice and consent of the city council or Visit Brookings, as the case may be, shall appoint a new member to complete the resigning member's term.
- If a member shall miss more than 50 percent of the meetings annually without authorization of the committee, they shall automatically be disqualified from serving on the committee, and a replacement shall be appointed.
Sec. 2-183. Quorum, action, liaison representatives.
A majority of the Dacotah Bank Center Advisory Committee shall constitute a quorum and it shall be necessary that all official action of the Dacotah Bank Center Advisory Committee shall be approved by a majority of the Dacotah Bank Center Advisory Committee. In addition, the city council of the City of Brookings may appoint a representative as a non-voting liaison to the Dacotah Bank Center Advisory Committee.
Sec. 2-184. Meetings.
The Dacotah Bank Center Advisory Committee shall hold meetings at a time and place to be designated by the Dacotah Bank Center Advisory Committee. Special meetings may be called at any time by the chairperson or by a majority of the Dacotah Bank Center Advisory Committee by giving 24 hours' advance notice to the public and other members of such committee. Notice of a special meeting shall be given a minimum of 24 hours prior to meeting time and shall state the reason for requesting the special meeting. Only business stated as the reason for calling a special meeting shall be transacted.
Sec. 2-185. Officers.
The Dacotah Bank Center Advisory Committee shall annually elect from its number a chairperson and vice-chairperson, each of whom shall hold their office respectively for one year and until their successors have been elected from their number.
Sec. 2-186. Duties of the chairperson.
The chairperson shall preside over all meetings and, as appropriate, make committee or special assignment appointments. The chairperson shall be kept advised of the general affairs of the Dacotah Bank Center and monitor the implementation of resolutions and policies with appropriate procedures. The chairperson shall have other usual powers and duties customarily vested in the office of chairperson and shall perform such duties as may be assigned by the committee.
Sec. 2-187. General authority.
The committee shall act only in an advisory capacity to the city council, however it shall, in particular, advise the city concerning marketing, operational issues and management of the Dacotah Bank Center, and in particular, shall advise and assist the city in the performance of Dacotah Bank Center – related contracts between the City of Brookings and the firm managing the Dacotah Bank Center.
II.
Any or all ordinances in conflict herewith are hereby repealed.
